GENERAL TERMS AND CONDITIONS OF SALE

Before placing orders on the website www.bartolucci.store, you must carefully read and accept the following General Terms and Conditions of Sale.

Article 1. The Company

The company Bartolucci S.r.l., with registered office at Via Del Commercio 1, 60021 Camerano (AN) - VAT number 02614850424 (hereinafter referred to as "Bartolucci S.r.l.") has created and manages the website www.bartolucci.store, through which it is authorized to sell its wall plugs and other fastening products (hereinafter the "Products") to users visiting the website (hereinafter the "Users").

Article 2. The Website

The website www.bartolucci.store (hereinafter the "Website") is an e-commerce platform accessible via the Internet at www.bartolucci.store.
The Website is accessible to all Internet users (hereinafter "Internet Users").

In the context of these General Terms and Conditions of Sale (hereinafter "T&Cs"), the term "Parties" shall refer to both Users and Bartolucci S.r.l., and "Party" shall refer to either of them individually.

The term "Buyer" shall refer to any User who has placed an order to purchase Products. The Buyer shall have the same rights and obligations as defined by these T&Cs. Orders with a delivery address that is a P.O. box cannot be processed. Users who wish to purchase on the Website declare, under their sole responsibility and with full awareness of the civil and criminal consequences of false declarations, that they have full legal capacity and are of legal age under Italian law.

Every order to purchase the Products offered on the Website implies consultation and express acceptance of the T&Cs, without this acceptance requiring the handwritten signature of the User.

Pursuant to articles 1321, 1322, 1326, 1335 of the Italian Civil Code, Legislative Decree No. 21/2014, Legislative Decree No. 185/99 implementing Directive 97/7/EC, and Presidential Decree 513/97, filling in and submitting the order form referred to in Article 5 “Order Registration and Confirmation Method” constitutes, for all legal purposes, a sales contract between Bartolucci S.r.l. and the Website User. This contract generates mutual rights and obligations governed by civil law and arising from the online sale of products and the relationships established exclusively via the Website. Users may save and print the T&Cs, provided no modifications are made.

The T&Cs define all the steps required to place an order as described in Article 4 "How to Place and Confirm Orders" and ensure the execution of the order between the Parties. The applicable T&Cs can be consulted at any time by clicking on the relevant link. Bartolucci S.r.l. may update these general terms and conditions at any time.


Final Customer

Bartolucci S.r.l. has created and published the website www.bartolucci.store with the aim of offering a service exclusively reserved for its customers. The products sold on www.bartolucci.store are intended for end consumers.

By “end consumer,” Bartolucci S.r.l. refers to a natural person acting for purposes unrelated to their business, professional, or legal activities, and not for the resale of goods purchased on www.bartolucci.store.

Bartolucci S.r.l. therefore invites users who do not qualify as End Consumers to refrain from attempting to establish commercial relationships with www.bartolucci.store or from submitting orders to purchase products through third parties.

In light of the commercial policy described above, Bartolucci S.r.l. reserves the right not to process orders for products not intended for End Consumer use or orders that do not comply with the above-mentioned commercial policies.

Article 3. Products

The Products offered for sale by Bartolucci S.r.l. are those listed on the Website on the date they are viewed by Users, subject to stock availability, and reflect the actual availability of each item. The photographs illustrating the Products do not form part of the contractual agreement; therefore, Bartolucci S.r.l. shall not be held responsible for any errors and/or discrepancies.

Product Availability

Products are offered while stocks last. In the event of unavailability of a Product, the Buyer will be informed promptly. Notification may occur:

  • during the order process: a window will appear indicating that the desired product is temporarily unavailable;

  • after order confirmation: before delivery, by email or phone.

If the unavailability of a product arises after the order has been confirmed, the Buyer may cancel the order and request a refund of the amount paid for the unavailable products within 14 (fourteen) days from the request, or request the replacement of the unavailable products by email.

Bartolucci S.r.l. disclaims all liability in the event of product stock depletion or unavailability. When a Website user places an order, they have the right to view all products that can be purchased online.

Retention of Title

The ordered products remain the property of Bartolucci S.r.l. until full payment has been received by the company and until the Products are physically delivered to and received by the Buyer. In the event of payment irregularities, the Buyer agrees to return the received products to Bartolucci S.r.l. upon first request. However, from the actual date of delivery, the risks (in particular those of loss, theft, or damage) relating to the delivered products are borne by the Buyer.

Article 4. Prices and Payments

Product prices are indicated in Euros and include VAT applicable at the time of the order. The price charged to the Buyer is the one indicated in the Order Confirmation. The stated price includes packaging costs, which are free for Users, but does not include shipping costs, which shall be borne by the Buyer, as well as any costs for delivery methods different from those normally provided, except for any promotions offering free delivery.

Bartolucci S.r.l. reserves the right to change the prices published on the Website at any time. In any case, the price of the Products, subject to availability, will be charged based on the rates indicated at the time the order is registered. The applicable VAT rate will be the one indicated on the Website, unless there are pricing errors, in which case Bartolucci S.r.l. will promptly notify the Buyer and give them the option to reconfirm the order at the correct amount or cancel it; if reconfirmation is not received, the order will be canceled, and the full amount paid will be refunded to the Buyer.

Payments

All payments can be made immediately online. Unless the server is unavailable, users of the website may pay via PayPal or Credit Card. In order to prevent and reduce the risk of unauthorized access, credit card data will be encrypted.

In accordance with current legislation, all purchases made through the website will be subject to value-added tax (VAT), pursuant to current Italian law and Chapter I of Title V of Council Directive 2006/112/EC of 28 November 2006 on the common system of VAT, according to which deliveries are considered to take place in the Member State corresponding to the delivery address of the items.

Bank transfer payments and cash on delivery (only for deliveries in Italy) are also available.

Article 5. Order Placement and Confirmation Method

Browsing the Website – Users may view and select the various products offered by Bartolucci S.r.l. at the following address: www.bartolucci.store. Users can browse the different pages of the website freely, without any purchase obligation.

Placing an Order

If a user wishes to place an order, they must select the various products of interest by clicking the “Add to Cart” button. Each new product added to the cart will be indicated by a specific pop-up. At any time, users can:

  • view a summary of selected products or modify the order by clicking the “Cart” button, located at the top right of every page,

  • continue selecting products by clicking “Continue Shopping”,

  • complete product selection and place the order by clicking “Proceed to Checkout”.

To order the selected products, users must click the “View Cart” button. An order summary will appear on screen. If the list displayed matches the selected Products, users must confirm their selection by clicking the “Proceed to Checkout” button. The User must then log in by entering their email address and password, if already registered on the Website. The User acknowledges and agrees that entering their login credentials constitutes proof of their identity and consent.

In the case of a new registration, the User agrees to complete the registration form in good faith and acknowledges that the information provided and recorded on Bartolucci S.r.l.'s information systems is accurate and valid as proof of their identity.

To complete the order, the User must strictly follow all steps outlined in this section. By using this Website and/or placing orders through it, the User agrees to use the Website only to make valid inquiries or orders, and therefore not to place false or fraudulent orders, which will be subject to cancellation by Bartolucci S.r.l.

Final Order Confirmation

The user must click the “I accept the general terms and conditions of sale” checkbox before proceeding to the payment method selection. Users will then be prompted to enter credit card information or log into their PayPal account. Orders are validated once the card information is entered or the request is authorized through PayPal.

Upon acceptance, even partial, of the order by Bartolucci S.r.l., the contract between the company and the User/Buyer will be deemed finalized. Bartolucci S.r.l. reserves the right, at its sole discretion, to accept the order. Acceptance shall be deemed tacit unless otherwise communicated to the User. The User is not entitled to compensation or indemnity, nor is Bartolucci S.r.l. liable for any direct or indirect damage to persons and/or property due to non-acceptance of the order.

Order Confirmation

Once the Buyer has validated their order and payment details, a summary window will appear showing the transaction number, the order receipt (hereinafter “Order Confirmation”), and confirmation that the order is being shipped (hereinafter “Shipping Confirmation”). This confirmation will also be sent to the Buyer by email. The confirmation will include all the components of the contract entered into between the Parties, including the Products ordered, payment details, delivery arrangements, and the address of Bartolucci S.r.l.’s office for any complaints, as per Article 1 of these T&Cs.

In any case, it is advisable to keep a copy (electronic or printed) of the order information. The data recorded and stored on the Website constitutes full proof of all transactions made between the Buyer and Bartolucci S.r.l. In case of a dispute regarding a transaction made on the Website, the data recorded by Bartolucci S.r.l. will serve as full proof of the content and transaction. Bartolucci S.r.l. retains a copy of the contract concluded between Bartolucci S.r.l. and the Buyer in electronic format.

Article 6. Delivery Methods and Delivery Times

Orders are shipped within the time frame indicated in the Order Confirmation and, in any case, no later than thirty (30) working days from the day following receipt of the order confirmation email. Products ordered by a Buyer will be delivered to the address indicated in the order form.

If delivery cannot take place for reasons not attributable to Bartolucci S.r.l. within 15 days from the date the order becomes available for delivery, the Contract shall be terminated. Deliveries are not made on Saturdays, Sundays, or public holidays, and deliveries will be carried out by courier.

Delivery Issues in Case of Delay

The Buyer must notify Bartolucci S.r.l. customer service as soon as possible by writing to: store@bartolucci.eu or using the contact details provided in Article 1 of these T&Cs. Bartolucci S.r.l. undertakes to contact the courier service for verification. The duration of such verification cannot be predicted.

In the event of failure to meet the delivery terms or deadlines, the Buyer is entitled to terminate the contract pursuant to Article 61 of Legislative Decree No. 21/2014, and receive a refund of the amount paid. However, Bartolucci S.r.l. will inform the Buyer in advance of any delays to determine whether the Buyer agrees to accept the delay and postpone the delivery.

Additionally, it is specified that shipping risks, as well as those related to the loss or damage of Products, are borne by the Buyer from the moment the Buyer physically acquires the Products.

After receiving the ordered Products, the Buyer must verify that the Products match the order. To check for any anomalies (missing or damaged products, damaged packaging, tears, etc.), the User may accept the Products under verification and, if such issues are found, must report them within 24 hours on the form included with the order and contact Bartolucci S.r.l. customer service at: store@bartolucci.eu or through the contact details in Article 1 of these T&Cs, clearly specifying the anomalies found.

Any claims not reported or submitted within 24 hours from product delivery will be rejected and Bartolucci S.r.l. will not be held liable. Bartolucci S.r.l. cannot be held responsible for lost or misdelivered products due to incorrect delivery addresses provided by the Buyer, as transport-related risks are borne by the Buyer.

Providing personal delivery details is mandatory, as they are required to process and ship orders and prepare the invoice. These personal details are strictly confidential. Failure to provide them will make it impossible to proceed with the order.




Article 8. Legal Warranty

The legal warranty of conformity is governed by Articles 128 et seq. of the Italian Consumer Code in favor of consumers who purchase products for personal use (or for purposes unrelated to their professional or business activity) that show defects in conformity. A conformity defect covered by the legal warranty exists if the purchased product is defective, does not allow for the normal use of products of the same type, or does not match the description provided by the seller.

The legal warranty of conformity does not cover product defects resulting from normal wear and tear, abnormal or improper use, accidental events (e.g., dropping), or damage caused to the product itself. It also does not cover defects arising from repairs performed using unauthorized methods or centers. In the presence of a conformity defect existing at the time of delivery: the Buyer has the right to have the product brought into conformity, at no cost, through repair or replacement. The Buyer may choose either remedy, unless the requested solution is objectively impossible or excessively costly compared to the alternative.

Repairs or replacements must be carried out within a reasonable time from the request. Secondly (where the first two remedies are impossible or excessively burdensome, or not completed within a reasonable time, or are inconvenient), the Buyer may request, at their discretion, a reasonable price reduction—taking into account the use made of the product—or contract termination. Any commercial warranties provided by the manufacturer or retailer in addition to the legal warranty of conformity do not replace or limit the rights arising from the legal warranty.

The legal warranty of conformity covers defects that occur within two years from the delivery date of the purchased product, provided that such defects are reported by the consumer within two months of discovery and that the Buyer can provide proof of purchase (invoice or receipt) clearly indicating the Product.



Article 9. Force Majeure

Neither party shall be held liable for the total or partial failure or delay in fulfilling any of the contractual obligations due to an event that cannot be prevented (hereinafter referred to as “Force Majeure”). Force Majeure events may include, but are not limited to, wars, riots, uprisings, major disruptions to internet security, technical failures, unauthorized access and/or hacking of the Website servers, and any form of strike or phone service outage.

If one Party believes a Force Majeure event has occurred, they must inform the other Party within 5 working days of the event or the risk of it occurring. The Parties agree to meet and jointly determine the terms and conditions for fulfilling the orders during the Force Majeure period. After one (1) month of disruption due to Force Majeure, Bartolucci S.r.l. may choose to cancel the pending orders and refund the Buyer, if applicable.



Article 10. Personal Data Protection

The provision of personal data collected in the context of distance selling is mandatory, as this information is necessary to process and deliver orders and to issue invoices. This data is strictly confidential. Failure to provide such information will result in the automatic rejection of the order.

In accordance with Law No. 78-17 of January 6, 1978 on information technology, files, and freedoms, the processing of personal data collected on the Website has been declared to the National Commission on Information Technology and Liberties. Users have the right to access, modify, rectify, and delete their personal data. To exercise this right, the User must send an email to: store@bartolucci.eu.



Article 11. Partial Invalidity

If one or more clauses of these T&Cs are deemed invalid or are declared as such by law, regulation, or final judgment, all other clauses shall remain fully valid.



Article 12. Entire Agreement

These T&Cs and the complete order summary sent to the Buyer form an integral part of the contractual relationship between the Parties. In case of discrepancies between these documents, the T&Cs shall prevail.



Article 14. Changes to This Information

Although Bartolucci S.r.l. will never process data other than as expressly authorized and/or requested by each User, this information may be amended to comply with new legal provisions or changes to Bartolucci S.r.l.'s data processing policies. Each updated version of this information will be made available on the Website in the dedicated section. Bartolucci S.r.l. therefore invites all Users to periodically consult the Website to remain informed about the latest version.
